Terms of use

The rules for using this website. They are short, and they do not cover using Baton itself: a clinic that uses Baton signs a separate agreement.

1. Who we are

baton-clinical.com is run by Baton Clinical Ltd, a company registered in England and Wales with company number 17548392. Our registered office is 1a Blunts Lane, Whittlesey, Peterborough PE7 1AH. In these terms, "we" and "us" mean that company, and "you" means anyone who uses this website.

2. What these terms cover

These terms apply when you use this website. By using it, you accept them. If you do not accept them, please do not use the website.

They do not cover using Baton. A clinic that takes a trial or buys Baton agrees a separate contract with us, with our data processing agreement. That contract decides what we provide, what it costs, and what each side is responsible for. If anything on this website differs from that contract, the contract wins.

Our privacy notice explains how we use any personal information you give us.

3. The information on this website

This website describes Baton and what it does. We work to keep it accurate and up to date, but it is general information about software, not advice. In particular:

• It is not clinical advice. Nothing on this website tells a clinician how to treat a patient. The patient examples and charts are illustrations, not real patients. Clinical decisions are always made by the clinic's clinicians, using their own judgement and the guidance that applies to them.
• It is not legal or regulatory advice. Where we say how Baton helps a clinic meet a standard, the clinic remains responsible for meeting it.
• Features may change as Baton develops. Before you rely on a feature, ask us to show it to you.

4. Prices and trials

Prices on this website are in pounds sterling and exclude VAT. The price calculator gives an estimate, not a quote. We may change our prices, and the price that applies to a clinic is the one in its contract.

A request for a trial is not a contract. We may decline a request, for example if Baton is not suitable for the clinic or we are not taking on more clinics at that time. The founding clinic offer is for a limited number of clinics and is agreed in writing.

5. Using the trial request form

• Give true details, and use the form only to ask about Baton.
• Do not include any patient information, or anything about a person's health.
• Baton is for clinics and their staff. If you are a patient, please contact your clinic.

6. What you must not do

You must not:

• try to get into any part of this website, Baton, or the servers they run on, that you are not allowed to
• introduce viruses or other harmful code, or attack the website, for example by flooding it with requests
• use the website in any way that breaks the law
• copy large parts of the website, or collect information from it automatically, except as search engines do.

If you think you have found a security weakness in this website or in Baton, please tell us at hello@baton-clinical.com and do not test it further. We will thank you and fix it.

7. What belongs to us

The content of this website, including the text, drawings, design and the Baton name and logo, belongs to us or to the people who licensed it to us. You may read it, print a page or share a link to it. You may not copy it for commercial use without our written permission.

The fonts used on this website are licensed under the SIL Open Font License 1.1.

8. Links to other websites

Where this website links to another, such as a regulator's guidance, we do so for your information. We are not responsible for what other websites say or do.

9. Our responsibility to you

We do not exclude or limit our responsibility where it would be unlawful to do so. That includes responsibility for death or personal injury caused by our negligence, and for fraud.

The website is provided free of charge, to tell you about Baton. Apart from what we cannot exclude:

• we do not promise that the website will always be available, or free of errors
• we are not responsible to a business for any loss of profit, sales, business, data or goodwill, or for any indirect loss, that comes from using this website or relying on what it says.

Our responsibility to a clinic that uses Baton is set by its contract with us, not by these terms.

10. Changes

We may change these terms. The date at the top says when they last changed. The terms in force when you use the website are the ones that apply.

11. Which law applies

These terms are governed by the law of England and Wales, and the courts of England and Wales may decide any dispute about them.
